In October 2025, Governor Newsom signed four landmark bills into law — AB 462, AB 1154, SB 9 updates, and SB 543 — each targeting a different barrier to ADU construction. These laws took effect on January 1, 2026, and represent the most significant package of ADU reforms since the original ADU boom legislation of 2017.

SB 543: Faster Permits, Stronger Homeowner Rights

SB 543 primarily focuses on application processing protections. It requires local agencies to determine whether an ADU application is complete within 15 days of receipt.

Under SB 543, if a local agency fails to issue a completeness determination within 15 business days, your application is automatically deemed complete and the 60-day review clock starts. If the agency then fails to approve or deny your complete application within 60 days, the permit is automatically deemed approved — and you can proceed with construction under your submitted plans.

SB 543 also provides that ADUs or JADUs with less than 500 square feet of livable space are exempt from school impact fees.

Under SB 543, all size measurements now refer to interior livable space — exterior walls and stairs are excluded from the calculation.
